PIINS Capture Agreement
Version 1.1 · Effective November 6, 2026
This agreement is between Dashing Media LLC, doing business as PIINS ("PIINS", "we"), and the business named in the Capture order form ("you").
The order form is part of this agreement. It records:
- your business and trade;
- the lines covered;
- your guarantee number;
- your go-live date.
F.1 What Capture does
Capture answers the calls your business doesn't take:
- Your number stays yours. Calls you don't answer forward to your PIINS line.
- It answers. Every call starts with a notice that the caller is speaking with an AI assistant and that the call is recorded.
- It asks what matters: the job, the address, and how urgent it is.
- It books the job onto your connected calendar, as a confirmed appointment with name, phone, address and time.
- It sends one text, only if the caller agrees on the call. The appointment details go in a single message, and anyone can reply STOP. The caller's agreement is kept in the recording.
- It passes you what it shouldn't handle. When a call needs you, the caller's details reach you right away.
- Every week, a report: calls answered, jobs booked, and the recordings.
Capture works around the clock.
What Capture never does:
- call or text anyone who didn't call you first;
- send more than one text per call (apart from the automatic answers to STOP or HELP);
- pretend to be a person;
- promise income.
F.2 Not an emergency service
Capture is not an emergency service. When a caller describes a situation that may put people or property at immediate risk, such as a gas smell, fire, smoke, or flooding near electricity, the assistant is instructed to tell them to call 911 or their utility, and not to book a visit in place of that call. It may not recognize every emergency.
You remain responsible for your own emergency procedures.
F.3 Go-live and texting
When you are live. Capture is "live" on the day it starts answering your forwarded calls. Billing starts that day, and the 30 live days of the guarantee are the 30 consecutive calendar days that start that day.
Texting needs its own registration. The phone carriers require every business that sends texts to register in its own legal name. Before Capture can text your callers, you provide the details needed for that registration:
- your business's legal name, EIN, address and an authorized contact;
- or the sole-proprietor details, if you have no EIN.
How it works in practice:
- PIINS files the registration and pays its fees.
- Calls are answered from your go-live date.
- The single text to callers starts when the carriers approve your registration.
F.4 Price and billing
- Price: US$997 a month, at the founding price.
- Setup: US$0.
- The founding price: the first 20 accounts keep US$997 a month for 12 months from go-live. After that, we may change the price with 30 days' written notice.
- Billing: monthly, by card, from your go-live date.
- Contract: month to month. You can cancel before your next billing date, and Capture stops at the end of that month.
- Refunds: months already started are not refunded. The Performance Guarantee works as a month not charged (F.8).
- If you don't pay: if a payment fails and isn't fixed within 10 days, we may pause Capture until it is.
F.5 Your responsibilities
You agree to:
- Forward your unanswered calls to your PIINS line, set to roughly two rings, and keep that forwarding on.
- Keep your calendar connected, with your real availability.
- Give us accurate information about your services, service area, hours and prices, and update it when it changes.
- Act on the calls Capture passes to you.
- Use Capture only for calls that come to you. You will not use it to place calls or send texts to anyone who did not call you first.
- Keep your business licenses and follow the laws that apply to your trade.
- Keep a privacy policy on your website that covers text messages to your customers, as the phone carriers require for your registration. We can give you the wording.
F.6 Recording and disclosure
Capture tells every caller, at the start of the call, that they are speaking with an AI assistant and that the call is recorded. This disclosure is required by our service and by several state laws, and it cannot be turned off.
F.7 Your data
Ownership. You own your customer information: callers' details, recordings, appointments and reports.
How we process it. We process it as your service provider, only to provide Capture:
- we don't sell it;
- we don't use it to market PIINS or anyone else;
- we don't let the AI providers we use keep it for their own purposes.
How long we keep it.
- While this agreement lasts, we keep each recording for 12 months, and call logs and appointments for as long as the agreement lasts.
- You can ask for an export, or for earlier deletion, at any time.
- After this agreement ends, we keep your data for 30 days so you can ask for an export, and then delete it, unless the law requires us to keep it.
Your own privacy policy should tell your customers that you use a service provider to answer calls.
F.8 The Performance Guarantee
The guarantee. 3 booked jobs from the calls we answer in your first 30 live days, or next month is free.
Where it applies:
- Roofing and HVAC repair: your number is 3.
- Other trades: your number is set in the Leak Audit, from your own call log, and written into your order form before you sign. If the numbers don't support a guarantee, the order form says so, and Capture is sold without one.
What it requires:
- at least 20 inbound calls a week, confirmed in the Leak Audit;
- unanswered calls forwarded to your PIINS line;
- your calendar connected.
The definitions:
- A booked job is a confirmed appointment with name, phone, address and time. Part G says exactly how they are counted.
- The guarantee applies once per client.
- The full terms are in part G.
F.9 No promise of results
Capture answers, books and reports. Whether a booked appointment becomes paid work depends on you and your customer. Outside the Performance Guarantee, PIINS does not promise any number of calls, jobs or revenue.
F.10 Ending the agreement
You can cancel as described in F.4.
We can end the agreement:
- with 30 days' written notice, but not during the 12 months of the founding price;
- immediately, if Capture is used in breach of F.5;
- immediately, if a payment stays unpaid for 30 days.
F.11 Limitation of liability
- Indirect damages: to the fullest extent the law allows, neither party is liable for indirect, incidental, special or consequential damages, or for lost profits, lost jobs or lost business.
- Missed and mishandled calls: this includes calls that were not answered or were handled imperfectly, and the consequences of a caller not calling 911 or their utility.
- The cap: PIINS's total liability under this agreement is limited to the fees you paid in the 3 months before the event that caused the claim.
- Your use: you will defend and indemnify PIINS against third-party claims arising from your breach of F.5, or from information about your business that you gave us and that turns out to be wrong.
F.12 General
- Governing law: the laws of the State of New Mexico govern this agreement.
- Disputes: they go to the state or federal courts in Bernalillo County, New Mexico, after 30 days of good-faith effort to resolve them in writing. Either party may use small-claims court where it qualifies.
- The whole agreement: this agreement, your order form and the guarantee terms in part G are the entire agreement for Capture. If they differ, the order form controls, then part G, then this agreement.
- Language: if we give you a translation, the English version controls.
- Changes: they must be in writing.
- Notices: they go to hello@piins.com, and to the email on your order form.
